Occupiers' Liability Claims & people lawfully on the premises
Accidents commonly occur on property or land owned by somebody else. We call these “occupiers’ liability claims”. They include all sorts of accidents in all types of places, such as slipping in a supermarket or tripping in a park, an accident in a children’s play area, a shop, or a garage. In such cases, the Occupiers Liability Act 1957 will be relevant.

Tripping accidents on public footpaths and roads
Many of us will have been walking on a footpath and noticed a defect-perhaps a broken kerb, or a flagstone sticking up, or even a pothole. Maybe you have been out cycling and had to swerve around a large hole in the road. Most of us have tripped at some point having been unfortunate enough not to notice a defect. Thankfully, on most occasions no injury is caused. But what if you are injured? Can you claim compensation?

Compensation is changing
Most people are aware that if they suffer injury because of someone else`s fault they can claim compensation. Years ago, the process of claiming compensation was a quiet, boring industry that did not attract very much attention from the media or the Government. However, following the virtual abolition of legal aid and the introduction of a “no win-no fee” system a new and somewhat less restrained market opened up. Very soon you could not switch on your radio or TV without someone offering to take your case on a no win no fee contract.
